Registration of Title to Garden Freehold: Background Information

At the 2023 AGM, residents voted to begin the process of registering title to ownership of our garden’s freehold.  The process will take some months to complete, and is now underway.  The narrative below outlines the steps taken leading up to the decision, and the reasons why it is advisable.  Linked documents provide more background information.

Robert Barham is RBKC’s external legal adviser for garden squares.  In January 2022, he posted a briefing note regarding registration of title to ownership of garden freeholds, noting that many of the squares have no registered owner and the stated intention of the Land Registry is to have all land registered by 2030.

Title registration would serve as a protection against the possibility of boundary encroachments and possible changes to the law that might affect unregistered land.  His briefing note was written in a general way, covering all gardens.

Information about the issue and about a Ladbroke Association meeting was first presented to residents at our AGM in November 2022, and a forum for preliminary discussion was proposed at that time.  The forum was held in April 2023, with Mr Barham in attendance.  It was decided that a further informal discussion among residents would be useful prior to formal presentation of the matter at the 2023 AGM.  This discussion was held on 1 November, and the formal vote was taken the AGM three weeks later.  All residents were cordially invited to attend each of the meetings, and the documents below give a sense of our shared views.  Updates on the process will be provided as it unfolds.
